Privacy Policy regarding BIMobject Cloud

The BIMobject Cloud (defined as the bimobject.com and the bimsupply.com platforms meaning the websites and web pages accessible on the bimobject and bimsupply domain at top level .com, excluding any third party links to other domains, collectively or in part(s) (the “BIMobject Cloud”) is operated by BIMobject AB (556856-7696), a duly registered Swedish company having its registered office and principal place of business at Nordenskiöldsgatan 24, 211 19 Malmö, Sweden (“BIMobject”).

Protecting your personal data is our priority. This privacy policy (the “Privacy Policy”) applies to all processing of Personal Data in the BIMobject Cloud and BIMobject’s provision of the Services (as defined in the terms and conditions regarding BIMobject Cloud (the “Terms”), as changed from time to time).

We encourage you to read this Privacy Policy carefully before using the BIMobject Cloud to get a clear understanding of how we collect, use, protect or otherwise process your Personal Data when you use the BIMobject Cloud.

Your acceptance of this Privacy Policy

Please note that your use of the BIMobject Cloud will constitute your acceptance of this Privacy Policy and the data practices described herein, as changed from time to time. If you register, or have registered, an account on the BIMobject Cloud you are further aware, acknowledge and agree that this Privacy Policy is expressly incorporated, by reference, in the Terms.

What information do we collect?

When registering for an account on the BIMobject Cloud you will be requested to provide information about yourself, such as your name, email address, phone number, postal code and city, country, company name, occupation and password, some of which information is required and some of which is optional, and which may change from time to time, when signing up for our newsletter, responding to a survey or marketing communication, submitting a message through BIMobjectMail or occasionally otherwise as part of your continued use of the Services (as defined in the Terms) you will also be requested to provide certain information about yourself. BIMobject will also collect certain information about you included in User Projects (as defined in the Terms) and information about your computer hardware and software which is automatically collected by the use of cookies such as, for example, your IP address, browser type, domain names, access times, referring website addresses as well as any BIM Object (as defined in the Terms), Content (as defined in the Terms) and/or other content on the BIMobject Cloud you have visited and/or downloaded, as well as any other personal identifiable information required to provide the Services (all such personal identifiable information is hereinafter jointly referred to as “Personal Data”).

How do we use your information?

We may use the information we collect from you as set out in this Privacy Policy in the following ways, some of which include providing your Personal Data to a Trusted Third Party (as defined below): To operate the BIMobject Cloud, to provide the Services and otherwise fulfill our obligations under the Terms, e.g. the following;

How do we protect Personal Data?

BIMobject undertakes to have in place appropriate technical and managerial procedures to safeguard the integrity of the Personal Data it processes, e.g. by securing the Personal Data on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure.

We do not use vulnerability scanning and/or scanning to PCI standards.

We do not use an SSL certificate. The reason for this is that all user services that require login are for free.

Your right to information about personal data collected about you

You have a right to receive, once a year and free of charge, information about your Personal Data being processed by BIMobject. This includes details in respect of circumstances of the data collection, the purpose of the processing and, where appropriate, details of the recipients to whom the personal data has been transferred. You may request access to your personal data by submitting a written request to BIMobject at stefan@bimobject.com.

Do we use 'cookies'?

The BIMobject Cloud will use "cookies" to help us personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

The primary purposes for BIMobject’s use of cookies are to provide you with a more convenient visit at our website and to enable us to save your preferences for future visits as well as to gather information about your use of the BIMobject Cloud and the Services to share with relevant Manufacturers (as defined in the Terms) and Trusted Third Parties.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the features of the BIMobject Cloud and the Services (as defined in the Terms).

Do we disclose information to third parties?

We will transfer certain of your Personal Data to companies with which BIMobject has some form of relationship, such as, but not limited to, subsidiaries, franchisees and companies with which BIMobject has binding contracts regarding the provision of the BIMobject Cloud and the Services, including companies contributing in the creation and/or provision of the Services and Manufacturers (as defined in the Terms) (“Trusted Third Party”) for the purpose of providing the Services, enabling certain Trusted Third Parties to contact you, through our cloud solutions or by using other contact details provided by you (with the exception of your email address), in matters related to the Services and as otherwise required for a Trusted Third Party to provide services or marketing communications closely related to BIMobject Cloud and the Services.

A Trusted Third Party can be located in a country outside the EU/EEA-area, i.e. a third country.

By accepting this Privacy Policy you consent to the transfer of your Personal Data to Trusted Third Parties as set out above.

Transfer of Personal Data to third party suppliers

We use different third party suppliers within and outside the EU/EEA-area to provide the Services and such third party suppliers will process certain of your Personal Data provided and/or collected as set out in this Privacy Policy, however only in accordance with BIMobject’s instructions.

What about third party links?

Occasionally, at our discretion, we may include or offer third party products or services on the BIMobject Cloud by links to third party websites. These third party websites have separate and independent privacy policies. We therefore make no representations with respect to such policies and the BIMobject has no responsibility or liability for the content and activities of these third party linked websites. Nonetheless, we seek to protect the integrity of the BIMobject Cloud and welcome any feedback about these third party websites.

Third party behavioral tracking, CalOPPA, CAN-SPAM Act etc.

What about Google or other third party behavioral tracking?

We have not enabled Google AdSense on our site but we may do so in the future. We do currently not allow any third party behavioral tracking on the BIMobject Cloud.

CalOPPA (California Online Privacy Protection Act)

How does our site handle do not track signals?

We honor them and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

COPPA (Children Online Privacy Protection Act)

We do not specifically market to children under thirteen and do not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use the BIMobject Cloud.

To be in accordance with CAN-SPAM we agree to the following:
We will NOT use false, or misleading subjects or email addresses.
We will identify the message as an advertisement in some reasonable way.
We will include the physical address of our business or site headquarters.
We will monitor third party email marketing services for compliance, if one is used.
We will honor opt-out/unsubscribe requests quickly.
We will give an 'opt-out' or 'unsubscribe' option

If at any time you would like to unsubscribe from receiving future emails, please follow the instructions at the bottom of each email.

Changes to this Privacy Policy

BIMobject will occasionally update this Privacy Policy to reflect company and customer feedback and to comply with any changes under applicable law. We encourage you to periodically review this Privacy Policy to be informed of how BIMobject is processing and protecting your Personal Data. A notification will appear in the BIMobject Cloud the first time you visit the BIMobject Cloud after any changes have been made to this Privacy Policy. Your continued use of the BIMobject Cloud and the Services after the date on which this Privacy Policy has been amended will constitute your acceptance of the amended Privacy Policy.
